It's not being built ON ground zero, that's where the new WTC is going to be built. It's kind of like a religious community center, and it's going to be built a few hundred feet away from the actual ground zero.

Just to put my personal view on this, most people would argue that while the mosque planners have the right to build there but that doing so would be tasteless, we have to ask if they really do have the right. Before you scream that this is anti-First Amendment, hear me out. As I understand the ban on respecting religion, the goverment has to ignore any religious aspect when making decissions, so the mosque/community center is simply a non-profit community center. This is fine, until you reallize that the land they want to use,while not where WTC used to stand, it is where a building already stands, a building that many opponents of the new community center argue would have been declare a historical site and protected had it not been for political pressure. Second, the planners have so far (as far as I know)been unwilling or unable to show where the money to develop the property came from, if in fact they even have it. While this is required of any structure in NYC, it's especially necessary in the face of allegation that money is coming from sources hostile to America (which is a valid allegation if for no other reason than that the lead imam on this project is an idiot) Finally, if NYC doesn't give them special permission to build wherever they want because they are a religious structure, NYC has every right to deny the permission to build, and a clear parallel can be drawn between the mosque near Ground Zero and the Walmart that didn't go up in Times Square, and the distinct lack of any Walmart in NYC.

New Yorkers have protested the construction of Walmart stores out of legitimate concern for small local businesses. On the other hand, the Muslim community center, if built, probably won't drive anyone out of business.
